Assumption of Risk and Liability Waiver Form
This Assumption of Risk and Liability Waiver (hereinafter referred to as the "Waiver") is executed by the undersigned participant (hereinafter referred to as "Participant") in favour of Sandy River Adventures LLC, an Oregon limited liability company, with its principal office at 39050 SE Gordon Creek Rd Corbett, OR 97019, and its owners, managers, employees, agents, representatives, successors, and assigns (collectively referred to as "Sandy River Adventures" or “Company”).
The Company operates a business providing rentals of rafts, kayaks, stand-up paddleboards (SUPs), inner tubes, electric bikes (E-bikes), and electric scooters (E-scooters) for recreational use. The Participant acknowledges that participation in these activities involves inherent risks and voluntarily agrees to assume all risks associated with the use of the equipment provided by the Company, and to release the Company from any and all liability, claims, demands, causes of action, or losses, including legal fees and expenses, arising out of or related to the Participant's use of the rented equipment.
- Eligibility: Must be at least 16 years of age and physically capable of operating the equipment. Under 18 requires a parent or guardian's signature.
- Acknowledgement of Risks: The Participant understands and accepts the inherent risks of using equipment such as rafts, kayaks, SUPs, tubes, E-bikes, and E-scooters. These include injury, weather, water, wildlife, terrain, collisions, overexertion, and more — whether caused by the Participant, others, or conditions. Participation is voluntary and fully assumes all risks.
- Release of Liability: The Participant waives all claims against Sandy River Adventures, including claims of negligence. This release applies to injury, death, or property loss and is intended to be as broad as allowed by Oregon law.
- Equipment Use: Participant agrees to use the equipment responsibly, return it in the same condition, and follow all safety instructions and operational limits provided by the Company (e.g., no use above Oxbow Park or on freeways).
- Safety and Operational Instructions: Participant confirms they have received and understood all safety and usage instructions and agrees to wear required safety gear (life jackets, helmets, etc.) at all times.
- Medical Treatment: In case of emergency, the Company may obtain medical care for the Participant, who agrees to cover all costs and releases the Company from related liability.
- Indemnification: The Participant agrees to indemnify and defend the Company from any claims, costs, or damages caused by their actions, negligence, or misuse of equipment, including third-party claims.
- Severability: If any part of this Waiver is invalid, the rest remains fully enforceable.
- Governing Law: The Waiver is governed by Oregon law. Disputes shall be resolved in Multnomah County, Oregon.
- Acknowledgment of Understanding: By signing, Participant confirms they’ve read and understood this Waiver, and sign it voluntarily. They’ve had the chance to ask questions and receive satisfactory answers.
